BECOME A COACH - TERMS AND CONDITIONS

We are thrilled that you are interested in training to become a Happiness Explorer Life Coach. If you decide to train with us you will experience one of the most personally uplifting, challenging and inspirational periods of time in your life.

Please read the following information carefully and then tick the appropriate box to indicate that you have fully understood and accepted all terms and conditions of enrolment.

1. Agreement

These terms and conditions form the agreement between Life Cleanse Limited, trading as The Happiness Explorer (us”, our” or we”) and our Clients (you” or your”). This agreement commences when you enrol in the Become A Coach Course (the Course”) and continues until termination is made in accordance with these terms.

Life Cleanse Limited is a company registered in England and Wales under company number 09203315, and with a registered office at 19 Manor Park, Richmond, Surrey, TW9 1XZ. 

These terms and conditions come into effect on the date of signing (below), and automatically terminate upon completion of the Course, unless otherwise earlier terminated in accordance with these terms and conditions

2. Our commitment to you 

2.1 The Course is a twelve-month course, conducted by way of:

  • Four Modules
  • 17 x live online skills classes
  • 40 x pre-recorded business classes
  • 2 x live coaching demo’s
  • 3 x business clinics
  • 3 x practice sessions
  • 5 x live online business classes
  • 2 x in person weekends in London
  • 5 x group life evolution group coaching sessions
  • 7 x 121 sessions with your mentor
  • The Happiness Reset Six Step Programme
  • Buddy coaching
  • An online Trainee Support Group via a Private Facebook Group
  • Hardcopy course book
  • One ticket to our annual celebration weekend in Ibiza and meal
  • One final graduation online class

We reserve the right to change the content of the Course from time to time to best serve you, or due to restrictions caused by governmental rules or restrictions. This may include, but is not limited to, having to cancel live elements of the Course, and replacing these with virtual elements, where appropriate.

There are no virtual options for attending events which are in person. In person events have been created for the people attending in the room.

If, as a result of such a cancellation, you have to cancel accommodation and/or transport, we will not be responsible for these costs. As a result, we advise you to take out travel insurance before making these purchases.

All trainees receive the Become A Coachmaterials which have been created specifically for the Course. The Course manual shall be posted approximately 2 to 4 weeks prior to the start of your Course start date. In the case that this is not possible, a digital version shall be provided in the meantime.

2.2 Whilst we encourage you to find clients, and we will support you as best we can to obtain clients, we are not responsible for finding those clients for you. The number of clients you work with and coaching hours you gain are your sole responsibility. These are not guaranteed with the Course. We will advise you as best we can, but do not take any responsibility for your results from the Course. You understand and acknowledge that your results are a reflection of your commitment and hard work.

2.3 We share an example agreement created by The Happiness Explorer and by The ICF for your coaching partnerships. Please be aware that these have not been reviewed by a lawyer, are not advised to be appropriate or tailored for you and may not be appropriate for the country in which you are located. We would advise you to seek specialist legal advice before using the example agreement. We do not provide legal advice.

2.4 The classes and mentoring are led by trained coaches on The Happiness Explorer team. Lydia will occasionally lead some classes or in some instances cover classes when needed. She will lead the coaching demos, The Happiness Reset, plus all live weekends. However in the unlikely event that Lydia was unable to lead these classes, they will be covered by a member of the team.

2.5 The ticket to our annual celebration weekend in Ibiza is a bonus gift outside of what is a part of the course. This has no part of whether you graduate the course or not. We reserve the right to cancel this event or move it's location. This event is open to the public also. This does not include your flights, accommodation or food. Your free ticket is valid for the event directly following the end of your course only. This may mean there is a long wait to attend. If you attend you will have the opportunity to deliver a short talk and to celebrate your graduation in person with Lydia.

3. Enrolment and Commencement

The Course begins on May 7th 2023 which is considered to be month one.

We accept enrolments at any time from the date enrolment opens and prior to the commencement of the Course, until sold out. Once the enrolment fee / deposit has been received on the terms below, you will receive an email confirming your place and your next steps.

The size of the class can vary and there are no guarantees on how many students will be in your cohort. The maximum number of students is 22.

After your acceptance into the Course you are welcome to contact info@thehappinessexplorer.com with any questions you may have. Once the course has started, all communication is via email, Kajabi and Facebook. Lydia will not be available via her personal number or for one-to-one calls. 4. Your commitment to us

4.1 The Course requires a commitment of time, cooperation and participation. The Course runs for twelve months. It is our experience that to successfully complete the Course, trainees need to dedicate approximately 1 to 2 hours of study per hour of live classes. So if you have one online class in the week, you would need to allow another 1 to 2 hours of study that week also. These are recommendations only, and everyone will differ.

4.2 You acknowledge that undertaking the Course may at times be personally challenging and you will not knowingly undertake the Course if you believe that you will not respond well to personal conversations, personal growth and constructive feedback.

4.3 We record all group calls and, by enrolling in the Course, you consent to these recordings. The recordings are made available to trainees in the Course and we may however, decide to include these recordings as part of the online training which by agreeing to these terms, you consent to. These recordings are not deemed to be personal data, as by participating, you make a decision to speak publicly. While we do our best to ensure that group calls are recorded so that you can catch up on missed calls, we cannot always guarantee that they will be recorded, and you cannot rely on them being recorded. If you volunteer to be coached during a coaching demo with Lydia, all coach demonstrations may be used on The Happiness Explorer and Lydia Kimmerling social media.

4.4 It is highly recommended that you be on every call possible for your growth and learning. We cannot guarantee that calls will be at times that are suitable for you. It is your responsibility to ensure you can make the calls. You are not entitled to a refund because you have not attended calls or not fully participated in the Course.

4.5 If you are knowingly struggling with mental health issues, are depressed or taking antidepressants, you must inform us of this in your personal details form. Whilst the company cares for your wellbeing, the company is not responsible for your wellbeing. If you find yourself struggling with the course due to mental health issues, please contact us immediately via email so that we can support you and discuss what will be best for you. We do not advise participating in this course if you believe to be suffering from depression or have been diagnosed with depression.

5. Your commitment to each other

5.1 You acknowledge that you are undertaking an adult learning process and that everyone has individual approaches to learning and participation. You acknowledge that there may be times when you or other trainees will have a difference of opinion or values and that you will deal with those differences with dignity and respect for yourself and others. If you do not comply with this, we reserve the right to remove you from the Course, without refund.

5.2 All trainees will pair with a fellow trainee that you will practice your coaching skills on throughout the Course. Your training partner (buddy coach) will change throughout the Course. You will treat your buddy coach with confidentiality, respect and professionalism. If you do not comply with this, we reserve the right to remove you from the Course, without refund. As a buddy you will also pay it back and buddy with a student on the following years course to help guide them through the process.

5.3 There is an additional time commitment in having a buddy coach, and gaining coaching experience outside of the Course. We encourage you to work towards gaining 50-100 hours of coaching experience during the twelve months (you are required to log 40 hours to become certified). Communications with your buddy coach can occur in person, via phone or Zoom (or similar).

5.4 You must commit to making yourself available at times that are mutually convenient to you and your buddy coach throughout the Course.

5.5 The Happiness Explorer cannot be held responsible for the connection between you and your training partner. Any breakdown in communication or engagement between the two of you is to be dealt with respectfully and privately, just as it would be with a coaching client and we will not intervene in that relationship unless gross misconduct is reported.

6. Participation requirements

6.1 Trainees agree to participate in the Course (including the Facebook group) in good faith and in a way so as to not bring disrepute or cause reputational or other damage to The Happiness Explorer

6.2 You agree that you will not upload or provide content on the Facebook group which is (Please read carefully):

  • Defamatory, fraudulent, unlawful, threatening, intimidating, harassing, disrespectful, inappropriate, harmful, hateful, abusive, tortious, obscene, invasive of anothers privacy, sexist, racist, homophobic, violent or degrading;
  • Infringes the intellectual or other proprietary interests of third parties;
    Contains spam, chain letters, pyramid and other such selling and marketing schemes, computer viruses, computer code, files or programs or other harmful components that are designed to interrupt, destroy, change or limit the functionality of happinessexplorer.com (the Site”) or any other computer software, hardware or other electronic equipment, information which in any way impinges on another users use or enjoyment of the Site or otherwise breaches or encourages other users to breach these terms and conditions; violates any law; or
    encourages or incites any other person to engage in any of the above behaviour.

6.3 You also agree that you will not:

  • Attempt to, or introduce viruses or any other computer code, files or programs that may interrupt, destroy or limit the functionality of the Facebook Group
  • Gain or attempt to gain unauthorised access to the Facebook Group including the networks or user accounts or
  • Attempt to or engage in conduct that damages, disables, overburdens, or impairs the Facebook Group servers or networks. 

6.4 We do not recommend the creation of private WhatsApp groups outside of the course. If you choose to belong to one, what happens in that group has no connection to the course and the company takes no responsibility for matters that occur in said group.

 6.5 We have a promise to help you get your first paying client within the time frame of the course. This means that we will give you the support, tools and strategy to make this happen. This does not mean that we will find the client for you. This is your responsibility. We can not force you to charge for your services, this part you will have to deliver. What you charge will also be decided by you, meaning that all students can have a different starting fee. We will encourage you to start charging from around 20 to 25 hours of experience. It's also your responsibility to get these practice hours in and to inform us as soon as you have them. Our promise is based on a partnership with you. We will give you 100% commitment and it requires the same promise from yourself to accomplish this mile stone. 

7. Your Financial Commitment

7.1 The course fee for 2023 is £8500 and there are two early bird offers available. 

  • until midnight January 31st 2023, pay in full £5000 inc VAT or pay in 12, total £6500
  • From January 31st to February 28th, pay in full £7000 inc Vat or pay in 12, total £7500

7.2 In order to secure your commitment in the Course, we require your first payment to be made during your discovery call with Lydia Kimmerling or via the website. Your first payment, whether it is a deposit, instalment or payment upfront, £499 will be deemed as a deposit from the moment the payment goes through—thus holding your space in the programme. Please note that your £499 deposit is non refundable.

7.3 While we provide all of the Course materials, trainees are responsible for the costs associated with participating in group training calls (cost of a local call/higher from mobiles or free via the web) and transport and accommodation, if and where required for live weekends.

7.4 If at any point in time throughout the Course you fail to make your Course payments, your certificate of completion will be withheld until your full Course fees are paid.

8. Transferring and Withdrawing

8.1 We conduct our services in accordance with, and you have the rights as provided by, consumer laws in the United Kingdom (the law”). Under the law, we are not required to provide a refund for a change of mind.

8.2 Cooling off Period

In accordance with our consumer obligations, we offer a cooling period during the period of time between your enrolment (when you make your first payment) and 14 days thereafter.

If you notify us prior to this time, you will receive a full refund of any fees paid minus your £499.00 deposit which held your space. The £499.00 deposit is a reflection of the administrative work involved in us enrolling you into the Course. The cooling off period does not apply if you have received the Course materials, as the Course will then be deemed to have commenced.

These refund rights only apply if you are a consumer in the European Union, and only last for 14 days from when payment is made (otherwise known as the cooling off period). After 14 days, no refund will be provided.”

8.3 Cancellations

If you decide to leave the course after the two week cooling off period, there will be no refund options available and whilst you are free to leave at anytime, your course fee must still be paid in full.

8.4 You acknowledge that, if necessary, The Happiness Explorer will engage the services of a Debt Collection Agency to attain any owed fees from your Course tuition that are outstanding and that if this is required you will be liable for the agency fees charged to do this. We reserve the right to remove you from the Course if you are in arrears and/or failing to be in communication with us about owed funds. You will be reinstated at any time you pay your owed fees. No removal from the Course without communication and opportunities to liaise with us regarding your owed fees will take place.

8.5 Transferring

If something arises prior to the first class and you would like to transfer to the next Course date, you may be eligible to transfer your enrolment to the next date as long as availability permits. Transfers are only possible if the Course fees continue to be paid on your current instalment plan, and are at our full and entire discretion.

9. Certification

9.1 To graduate the Course and call yourself a Certified The Happiness Explorer Life Coach you need to (please read carefully):

  • Complete all classes whether live or via the recording. If you watch via the recording, you must, after watching, state your three takeaways in the Facebook group - if more than 6 hours are missed, this attendance will be flagged and we will communicate this with you to check in with your current situation. If you are struggling to attend classes live, please let us know immediately so that we can support you.
  • Document a minimum of 50 hours, with five different clients. 25 of those hours will be unpaid and 25 will be paid or bartered. If you are struggling with your hours you must let us know immediately. We look for you to complete 50 hours of experience because this is when we expect your standard of coaching to be high. In certain circumstances where the hours are less than 50 but your standard is high, we will consider graduating you. Hours are to be logged into your coaching hours log and communicated with your mentor. This is done on a trust basis.
  • Complete all six of your 121 mentoring sessions and complete five group life evolution coaching sessions; watching the recordings if they are missed and your take aways into the Facebook group. You must also be completing your self reflection and session reviews as these contribute to your mentoring hours.
  • Complete your final session review to a good standard. This is the most important factor for your graduation. We want to see you display a good standard of coaching. We take into consideration your full journey on the course and not just what is displayed in the final session. 
  • Have not missed any of your session reviews - all mentoring sessions must be used before the end date of the course. You are not permitted to try and fit missed sessions in with your mentor close to the course end date. Allowing these sessions will be at the discretion of your mentor and their availability.

This is an internal certification pathway and not one with the International Coaching Federation. It is your responsibility to be aware of these requirements and undertake them if you wish to be certified with us. We do not make the assumption that any trainee or graduate wishes to be certified and therefore will not question your level of involvement or undertaking of certification requirements at any time.

Once certified with us you will receive a certified The Happiness Explorer Seal for your website and marketing material and a hard copy certificate.

It is in our interest for you to be certified by us as we do not wish to see you fail. It is for this reason that we avoid using language like pass or fail. What is most important is that you are meeting a high standard of coaching and have a strong understanding of the skill and how you can progress. The certification guidelines above are guidelines. If you are struggling and we are informed, we will do our best to support you and insure that you are meeting a standard. 

The most important part of your certification is your final session recording and not how far you have come in business. There is no part of your business progress which is recognized as part of your certification.

Primarily your final session recording is to complete this course. We do however work with you to hopefully make it a session you can use to apply to the ICF, should you wish. Since our certification process is different to that of the ICF, we can not guarantee that is will pass with them also. If we feel that it's not quite there for their process, we will give you the progress points you need to cover to rerecord in the future.

9.3 All decisions about whether or not you are granted certification status are final and no correspondence will be entered into.

9.4 You are aware that changes are being made to the course for 2023 which may include how we certify students and agree to these changes.

10. Warranties and Indemnities

10.1 We do not warrant that the Site or any Facebook Group operated by us will be uninterrupted or error free or that the Site, its content or the server are free of viruses or other harmful components. We maintain current anti-virus software, however to the extent provided by law, we do not guarantee against third party interference or that the Site or its content will be compatible with third party software or hardware. We are not liable for any default due to an act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, storm or other event beyond our reasonable control.

10.2 You agree to indemnify, The Happiness Explorer, its partners, licensors, affiliates, contractors, officers, employees and agents for any claim arising directly or indirectly from your acts and omissions in participating in the Course, or from using the Site and Facebook group pursuant to the terms of these terms and conditions.

10.3 You acknowledge that while you will be receiving training in a life coaching model and the building of a life coaching business, you will not hold The Happiness Explorer responsible for any-thing related to your personal business success or otherwise including your income and client attraction, including if you are profiled on the Site.

10.4 This Course includes six business launch modules which may be updated and changed during your course time. Your mentoring sessions are primarily for advancing your coaching skill and secondarily for advancing you in business. Whilst we offer much business knowledge and support we are not responsible for you obtaining paid clients or a successful business. Growing a successful business takes time, which could be longer than the duration of the course.

11. Ethical Marketing

We are committed to transparency, accuracy, and respect for our audience, upholding the highest standards of integrity and stakeholder well-being.

11.1 Transparency and Honesty:

  • Provide accurate information without misleading claims or deceptive practices.
  • Clearly disclose programme details, requirements, costs, and potential outcomes for informed decision-making.

11.2 Respect for Privacy and Consent:

  • Handle personal information with care and comply with data protection laws.
  • Obtain proper consent before using personal information for marketing and offer preference management options.

11.3 Inclusivity and Diversity:

  • Represent and respect the diversity of our community, avoiding discrimination or exclusion.
  • Promote inclusivity and equal access, welcoming individuals from all backgrounds and abilities.

11.4 Social Responsibility:

  • Avoid marketing practices promoting unethical behaviour, harm, or environmental damage.
  • Use marketing platforms for advocacy, supporting social responsibility and positive change.

11.5 Compliance with Laws and Regulations:

  • Adhere to applicable laws, regulations, and industry standards governing marketing practices.

We hold ourselves accountable and invite students to uphold these ethical standards in all marketing activities.

12. Intellectual Property

The Happiness Explorer retains the right to all intellectual property (whether registered or not) that is created by us and you agree not to disclose, sell or deal with our materials in any way other than in accordance with these terms and conditions.

You will not copy, transmit, reproduce or otherwise pass to any third party any of the content contained with the Course. You will indemnify us and hold us harmless against any breach of this clause 11, and we shall be entitled to seek equitable remedies against you in order to enforce this clause 11, including but not limited to specific implementations and injunctions

13. Inclusion and diversity

The Become a Coach Programme is committed to creating an inclusive and equitable environment for all individuals, regardless of abilities, and promoting diversity, equity, inclusion, and justice (DEIJ) throughout our program. We believe in equal access to opportunities and treating everyone with respect and dignity.

Our programme supports individuals with disabilities, providing them a platform to develop coaching skills and contribute to the happiness and well-being of others. We actively remove barriers to full participation and offer reasonable accommodations to support their needs.

Discrimination or harassment based on disability, race, ethnicity, gender, sexual orientation, religion, age, or any other characteristic protected by law is not tolerated. Our coaches, participants, and staff uphold and promote a culture of respect, inclusivity, and acceptance.

By embracing differences, we create an empowering environment that promotes active participation, personal development, and equal opportunities for individuals with disabilities.

14. Termination

These terms and conditions will terminate automatically upon completion of the Course. These terms and conditions will be terminated without notice if you fail to pay any amounts owing by the due date. We reserve the right to terminate these terms and conditions if a breach of the terms occurs. We also reserve the right to terminate these terms and conditions in the unfortunate event that we become unable to provide the services requested, in which case all monies paid for work not undertaken will be refunded.

If your Traineeship is terminated, you will no longer have access to the Site or the Facebook group. The restrictions imposed on you with respect to the material provided to you, payment obligations, and the disclaimers and limitations of liabilities contained in these terms and conditions will survive termination.

15. Governing Law and Jurisdiction

These terms and conditions, and any non-contractual obligations arising hereunder, are governed by the laws of England and Wales, and the courts of England shall have exclusive jurisdiction to deal with any dispute arising hereunder.

16. Queries and Concerns

If you have any concerns relating to the The Happiness Explorer or the Course, you are welcome to contact info@thehappinessexplorer.com asap detailing your concerns and how you believe it can be swiftly resolved, where you will receive prompt support and attention. We are a supportive and caring business who will liaise with you in a professional manner and we ask you to do the same for us too.

By ticking the box on the payment page, you are in agreement of the terms and conditions above. You also understand that terms and conditions may change, which you will be notified of in advance, with your agreement.
