Terms & Conditions

We are thrilled that you have chosen to become a The Happiness Explorer Partner. There are five main pillars for our partnership which are vision, visibility, credibility, opportunity and connectedness. For year one, we will be delivering on these via what's included below and in true THE style, we expect these to grow and develop.

Please read the following information carefully and then tick the appropriate box to indicate that you have fully understood and accepted all terms and conditions of enrolment.

1. Agreement

These terms and conditions form the agreement between Life Cleanse Limited, trading as The Happiness Explorer (“us”, “our” or “we”) and our Clients (“you” or “your”). This agreement commences when you sign-up for The Happiness Explorer Partners’ Membership (“THE Partners’ Membership”) and continues until termination is made in accordance with these terms.

Life Cleanse Limited is a company registered in England and Wales under company number 09203315, and with a registered office at 19 Manor Park, Richmond, Surrey, TW9 1XZ. 

Your membership and related terms and conditions come into effect on the date of signing (below) and automatically renew each year at the same time that you joined, unless you inform us in writing that you wish to leave with a minimum of exactly 30 days notice from the date your membership renews.

2. Our commitment to you 

2.1 Becoming a THE Partner includes a 12 month rolling membership including the following;

  • Partners' Profile on THE Website
  • Partners' Choice Highlighted Speaker
  • Quarterly Vision Think Tanks
  • Complimentary Admission to Alive Event in Ibiza
  • Featured Writer
  • Exclusive Partners' Logos
  • Partners' Events featured on THE Website
  • Private Online Community and Portal
  • Discounted One-To-One Coaching
  • Assistance with ICF Application

We reserve the right to change the exclusive offers and content within the portal from time to time to best serve you. We reserve the right to make alterations to events as a result of restrictions enforced by governmental rules and regulations. This may include, but is not limited to, having to cancel live events and potentially replacing with virtual events, where possible.

There are no virtual options for attending events which are intended to be in-person only. In-person events have been created to serve in-person only.

If unforeseen cancellations result in you having to cancel accommodation and/or transport, we will not be responsible for these costs. We therefore advise you to take out travel insurance before purchasing.

2.2 Thinks Tanks and other events are led or overseen by trained coaches on The Happiness Explorer team and/or specially selected experts. Lydia will occasionally lead some of these.

2.3 Your entry ticket to our Alive Event in Ibiza is part of your membership, though the event is also open to the general public. We reserve the right to cancel this event or move its location. Your ticket does not include travel, food or accommodation. Your ticket is entry only.

3. Enrolment and Commencement

3.1 Your membership and related terms and conditions come into effect on the date of signing (below) and automatically renew each year at the same time that you joined, unless you inform us in writing that you wish to leave  with a minimum of exactly 30 days notice from the date your membership renews.

3.1 We accept membership applications at any time. Upon acceptance of your application, payment of your membership fee can be made and you will then receive a confirmation email and login details.

3.2 After your acceptance as a THE Partner, you are welcome to contact info@thehappinessexplorer.com with any questions you may have. Once within the membership, all communication is via email, Kajabi and Facebook. The Happiness Explorer Coaches will not be available via their personal contact details or for one-to-one conversations, unless coaching sessions have been booked and paid for. Should you have any queries or concerns, please contact Denise who is our Membership Co-ordinator denise@thehappinessexplorer.com.

4. Your commitment to us

4.1 To get the most out of your THE Partners' Membership, you do need to commit your time, energy and engagement. The frequency and duration of time you commit is entirely up to you though we encourage you to maintain consistency and momentum. We cannot guarantee that all live sessions will be at times that are suitable for you. It is your responsibility to ensure you can make the lives sessions as often as possible. You are not entitled to a refund because you have missed sessions.

4.2 We intend to record all live sessions and by becoming a THE Partner, you consent to these recordings. The recordings are made available within the private portal and we may include some recordings as part of our marketing campaigns which, by agreeing to these terms, you consent to. These recordings are not deemed to be personal data, as by participating you make a decision to speak publicly.

4.3 While we intend to record all live sessions so that you can catch up and replay, we cannot always guarantee that they will be recorded, and you cannot rely on them being recorded. 

4.4 If you volunteer to be coached during a coaching demo, all coach demonstrations may be potentially be used as part of our marketing campaigns, which you consent to.

4.5 You acknowledge that some content may at times be personally challenging and you will not knowingly choose to become a THE Partner if you believe that you will not respond well to being challenged and challenging yourself.

4.6 If you are knowingly struggling with mental health issues, are depressed or taking antidepressants, you must inform us of this in your application form. Whilst the company cares for your wel-lbeing, the company is not responsible for your well-being. If you find yourself struggling with the content due to mental health issues, please contact us immediately via email so that we can support you and discuss what will be best for you. We do not advise becoming a THE Partner if you believe to be suffering from depression or have been diagnosed with depression.

5. Your commitment to each other

5.1 You acknowledge that you are undertaking an adult learning process and that everyone has individual approaches to learning and participation. You acknowledge that there may be times when you or other THE Partners' will have a difference of opinion or values and that you will deal with those differences with dignity and respect for yourself and others. If you do not comply with this, we reserve the right to cancel your membership without refund.

5.2 The Happiness Explorer cannot be held responsible for connections between you and other THE Partners'. Any breakdown in communication or engagement between you is to be dealt with respectfully and privately. We will not intervene in that relationship unless gross misconduct is reported.

6. Participation requirements

6.1 As a THE Partner you agree to participate as an active member. You will act in good faith and in a way so as to not bring disrepute or cause reputational or other damage to The Happiness Explorer

6.2 You agree that you will not upload or provide content within the Facebook group which is (Please read carefully):

Defamatory, fraudulent, unlawful, threatening, intimidating, harassing, disrespectful, inappropriate, harmful, hateful, abusive, tortious, obscene, invasive of another’s privacy, sexist, racist, homophobic, violent or degrading;

Infringes the intellectual or other proprietary interests of third parties;

Contains spam, chain letters, pyramid and other such selling and marketing schemes, computer viruses, computer code, files or programs or other harmful components that are designed to interrupt, destroy, change or limit the functionality of happinessexplorer.com (the “Site”) or any other computer software, hardware or other electronic equipment, information which in any way impinges on another user’s use or enjoyment of the Site or otherwise breaches or encourages other users to breach these terms and conditions; violates any law; or encourages or incites any other person to engage in any of the above behaviour.

6.3 You also agree that you will not:

Attempt to, or introduce viruses or any other computer code, files or programs that may interrupt, destroy or limit the functionality of the Facebook Group or Kajabi content.

Gain or attempt to gain unauthorised access to the Facebook Group, Kajabi content, servers, networks, user accounts, or;

Attempt to or engage in conduct that damages, disables, overburdens, or impairs the Facebook Group, Kajabi content, servers, networks or user accounts.

6.4 We do not recommend the creation of private groups of THE Partners' (WhatsApp or otherwise) outside of THE Partners' Membership. If you choose to belong to one, what happens in that group has no connection to THE Partners' Membership and the company takes no responsibility for matters that occur in said group.

7. Your Financial Commitment

7.1 All prices are displayed in Pound Sterling. The cost of THE Partners' Membership for 12 months is £500 inc VAT where applicable. We reserve the right to change the cost of THE Partners' Membership at any time. Any changes would come into effect at next renewal.

7.2 While we provide all of THE Partners' Membership content, THE Partners' are responsible for the costs associated with participating in membership sessions (cost of a local call/higher from mobiles or free via the web) and transport, food, accommodation where required for in-person events.

8. Transferring and Withdrawing

8.1 We conduct our services in accordance with, and you have the rights as provided by, consumer laws in the United Kingdom (“the law”). Under the law, we are not required to provide a refund for a change of mind.

8.2 Cooling off Period

In accordance with our consumer obligations, we offer a cooling off period during the period of time between your sign-up (when you make your payment) and 14 days thereafter.

If you notify us prior to this time, you will receive a full refund.

The above refund rights only apply if you are a consumer in the United Kingdom, and only last for 14 days from when payment is made (otherwise known as the ‘cooling off period’). After 14 days, no refund will be provided.

9. Warranties and Indemnities

9.1 We do not warrant that the Website, Kajabi Platform or any Facebook Group operated by us will be uninterrupted or error free or that the Website, its content or the server are free of viruses or other harmful components. We maintain current anti-virus software to the extent provided by law, however we do not guarantee against third party interference or that the Website or its content will be compatible with third party software or hardware. We are not liable for any default due to an act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, storm or other event beyond our reasonable control.

9.2 You agree to indemnify The Happiness Explorer, its Partners', licensors, affiliates, contractors, officers, employees and agents for any claim arising directly or indirectly from your acts and omissions in participating in THE Partner Membership, or from using the Website, Kajabi Platform and Facebook Group pursuant to the terms of these terms and conditions.

10. Intellectual Property

10.1 The Happiness Explorer retains the right to all intellectual property (whether registered or not) that is created by us and you agree not to disclose, sell or deal with our materials in any way other than in accordance with these terms and conditions.

10.2 You will not copy, transmit, reproduce or otherwise pass to any third party any of the content contained with THE Partners' Membership. 

10.3 You will indemnify us and hold us harmless against any breach of this clause 10, and we shall be entitled to seek equitable remedies against you in order to enforce this clause 10, including but not limited to specific implementations and injunctions.

11. Termination

11.1 These terms and conditions will terminate upon termination of THE Partner Membership. 

11.2 We reserve the right to terminate these terms and conditions if a breach of the terms occurs. 

11.3 We also reserve the right to terminate these terms and conditions in the unfortunate event that we become unable to provide the services requested, in which case all monies paid for work not undertaken will be refunded.

11.4 If your THE Partners' Membership is terminated, you will no longer have access to the Website, Kajabi Platform or the Facebook Group. 

11.5 The restrictions imposed on you with respect to the material provided to you, payment obligations, and the disclaimers and limitations of liabilities contained in these terms and conditions will survive termination.

12. Governing Law and Jurisdiction

These terms and conditions, and any non-contractual obligations arising hereunder, are governed by the laws of England and Wales, and the courts of England shall have exclusive jurisdiction to deal with any dispute arising hereunder.

13. Queries and Concerns

13.1 If you have any concerns relating to the The Happiness Explorer or the THE Partners' Membership, please contact Denise who is our Membership Co-ordinator denise@thehappinessexplorer.com detailing your concern and how you believe it can be swiftly resolved. We are a supportive and caring business who will liaise with you in a professional manner and we ask you to do the same in return.
